Privacy at a glance: Freely uses personal information to provide matching, messaging, safety, support, and paid features. Your profile information is visible to other members according to the Service design and your settings. We do not sell personal information for money. Some analytics or advertising disclosures may be considered “sharing,” “sale,” or targeted advertising under certain laws, and applicable opt-out rights are described below.
1. Scope and operator
This Privacy Policy applies to Freely’s mobile applications, freelydating.com, member applications, events, support interactions, marketing communications, and related products and services (collectively, the “Service”). The Service is operated by Swift Tech, LLC, a Georgia limited liability company doing business as Freely (“Freely,” “we,” “us,” or “our”), based in Atlanta, Georgia.
This Policy does not govern third-party websites, app stores, payment services, or services that publish their own privacy notices. Freely is for adults aged 18 and older.
2. Information we collect
Information you provide
- Account and contact data: name, email address, telephone number, login credentials, age or date of birth, account identifiers, and verification codes.
- Profile and preference data: photos, videos, audio or voice prompts, biography, gender identity, pronouns, sexual orientation, race or ethnicity if provided, relationship style, relationship goals, interests, values, lifestyle choices, height, education, job, school, religion, political views, family plans, and match preferences.
- User content and communications: messages, likes, reactions, prompts, profile answers, reports, appeals, feedback, surveys, event responses, and communications with support.
- Location: approximate or precise device location when enabled, selected city, distance settings, and location inferred from IP address.
- Verification and safety data: selfies, identity or age information if requested, moderation submissions, report evidence, blocking information, and safety-case records.
- Purchases: subscription tier, purchase status, transaction identifiers, renewal or cancellation status, virtual-item balances, and limited billing metadata. Apple, Google, or another processor generally handles payment-card details directly.
- Contacts or connected services: information received only when you choose to connect or authorize a supported service.
Information collected automatically
- device model, operating system, app version, language, time zone, IP address, mobile carrier, browser, device and advertising identifiers;
- dates and times of access, pages and screens viewed, taps, searches, matches, feature use, session duration, referring URLs, and crash or performance data;
- cookie, pixel, SDK, attribution, and similar technology data;
- security, fraud, abuse, authentication, moderation, and diagnostic signals; and
- inferences used to recommend profiles, personalize features, detect misuse, or understand likely preferences.
Some profile details and precise geolocation may be considered sensitive personal information under applicable law. You choose whether to provide many profile fields, but withholding information may affect functionality.
3. Sources of information
We collect information directly from you; automatically from your device and use of the Service; from other members who interact with or report you; from app stores, payment processors, authentication providers, advertising or attribution partners, analytics and security vendors; from services you authorize; and from public or lawful sources used for fraud prevention, safety, or legal compliance.
4. How we use information
We use personal information to:
- create, authenticate, maintain, and secure accounts;
- review applications and profiles and provide discovery, matching, messaging, location, recommendation, verification, and community features;
- show your profile and content to other members according to product design and settings;
- process subscriptions, purchases, virtual items, renewals, refunds, and account entitlements;
- provide customer service and send transactional, security, policy, and permitted marketing communications;
- detect spam, scams, impersonation, harassment, prohibited content, unauthorized access, and other abuse;
- investigate reports, enforce our Terms and Community Guidelines, preserve evidence, and protect people and the Service;
- measure performance, troubleshoot, conduct research, develop features, personalize the experience, and improve our systems;
- measure marketing and advertising effectiveness and, where permitted, deliver or limit advertising;
- comply with legal obligations, lawful requests, audits, tax and accounting rules, and dispute processes; and
- establish, exercise, or defend legal claims and protect our rights, property, users, personnel, and the public.
We may aggregate or de-identify information and use it for lawful purposes. We will not attempt to re-identify data that applicable law requires us to maintain as de-identified.
5. Profiles, matching, and communications
Freely is a social dating service. Information you place on your profile—including photos, age, selected location, identity, interests, lifestyle, relationship preferences, and prompts—is designed to be viewed by other members. Matches and recommendations may be generated using preferences, activity, location, and other profile or usage information. Recommendations are probabilistic and do not guarantee compatibility.
Messages are shared with their recipients. We may access or review communications when reported, when automated systems detect suspected violations, when needed to support a feature or account, or when lawfully required. Do not submit information you do not want recipients to retain or share.
6. Location information
With device permission, Freely may collect precise latitude and longitude to support proximity-based discovery, safety, fraud prevention, and relevant features. Other members may see approximate distance or location, not necessarily your exact coordinates. You can revoke device permission, but location-dependent features may stop working. Location information is sensitive; never use the Service to track or stalk another person.
7. Verification, photos, and biometric information
If Freely offers selfie, liveness, age, or identity verification, we and our verification providers may process photos, videos, identity details, device signals, and comparison or confidence results to verify authenticity and prevent fraud. Depending on the technology and jurisdiction, this may involve biometric identifiers or biometric information. We provide any additional notice and obtain consent where required.
Verification information is not used to guarantee a member’s identity, conduct, or safety and is not a criminal background check. We do not use biometric information for targeted advertising. We retain it only as long as needed for the disclosed verification, fraud-prevention, safety, and legal purposes, subject to applicable law and any supplemental biometric notice.
9. Analytics, advertising, sale, and sharing
We use analytics and measurement technologies to understand use, diagnose problems, prevent fraud, attribute installs, and measure campaigns. We may also use advertising partners where permitted. These partners may receive device identifiers, IP address, coarse location, app or website activity, and attribution events.
Freely does not sell personal information for monetary consideration and is not a data broker. However, “sale,” “sharing,” and “targeted advertising” are defined broadly by some U.S. state laws. Certain disclosures through advertising, cookies, SDKs, or measurement technologies may fall within those definitions even when no money is exchanged. Where applicable, you may opt out through available privacy controls, by contacting us, or through a legally recognized signal such as Global Privacy Control for web activity. We do not knowingly sell or share personal information of anyone under 18.
Apple App Tracking Transparency and comparable device permissions are honored where required. Disabling tracking does not necessarily stop contextual advertising or essential analytics.
10. Legal bases for processing
Where European Economic Area, United Kingdom, or similar law applies, we process information under one or more legal bases:
- Contract: to create your account and provide requested matching, messaging, subscriptions, and features.
- Legitimate interests: to secure and improve the Service, prevent fraud and abuse, support members, measure performance, and protect legal rights, balanced against your interests and rights.
- Consent: for precise location, certain sensitive profile information, marketing, tracking, or verification where consent is required. You may withdraw consent prospectively.
- Legal obligation: to comply with law, accounting, consumer, safety, and lawful-request requirements.
- Vital interests and public interest: in limited emergency, safety, or legally authorized circumstances.
11. Data retention
We retain information only as long as reasonably necessary for the purposes described, considering account status, feature needs, sensitivity, safety risk, legal requirements, limitation periods, and technical constraints.
- Active account and profile information is generally retained while the account exists.
- After voluntary closure, core account data may be retained for up to three months to process deletion, prevent accidental loss, and support safety or restoration requests.
- Records associated with bans, fraud, abuse, chargebacks, or significant safety incidents may be retained for up to five years or longer where reasonably necessary to prevent repeat harm or meet legal obligations.
- Transaction, tax, and accounting records may be retained for the period required by law, commonly up to seven years.
- Support, consent, dispute, and legal-request records are retained for the applicable operational or legal period.
- Backups are deleted or overwritten on a scheduled cycle; isolated copies may remain until that cycle completes.
Some information may remain in another member’s messages, de-identified datasets, or records we must preserve. When retention is no longer necessary, we delete, anonymize, or securely isolate the information.
12. Security
We use administrative, technical, and physical safeguards designed to protect information, which may include encryption in transit, access controls, logging, monitoring, backup, vendor review, and incident response. No system is completely secure. Use a unique password, protect verification codes and devices, and notify us promptly of suspected compromise.
13. Your choices and account controls
- Review and update profile and account information through available settings.
- Control location, camera, microphone, photos, contacts, notifications, and tracking through device settings.
- Adjust discovery, distance, profile, and communication settings where offered.
- Unsubscribe from marketing using the message link; operational communications may continue.
- Manage cookies through our consent tool and browser controls.
- Cancel subscriptions through the platform where purchased.
- Block or report members and request account deletion through settings or support.
Deleting the App does not delete your account or cancel a subscription. We may verify identity before fulfilling a privacy request.
14. U.S. state privacy rights
Depending on your state and subject to exceptions, you may have rights to confirm processing; access, correct, delete, or obtain a portable copy of personal information; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive information; and appeal a denied request. You may also have a right not to receive discriminatory treatment for exercising privacy rights.
Submit requests to privacy@freelydating.com. Describe the right and state of residence. We may request information to verify your identity and account. An authorized agent may act where permitted if authority and identity can be verified. To appeal, reply to our decision and state that you are appealing.
California residents should also review our California Privacy Rights Notice. California users may request information about categories collected, sources, purposes, recipients, and specific pieces of data, and may exercise applicable rights to delete, correct, opt out, or limit. California’s “Shine the Light” law may provide additional rights concerning certain direct-marketing disclosures.
Nevada residents may submit a verified request to opt out of covered sales under Nevada law, although Freely does not currently sell covered information for monetary consideration.
15. EEA, UK, Swiss, and other international rights
Where applicable, you may request access, correction, deletion, restriction, portability, or objection; withdraw consent; and complain to your local data-protection authority. You may object to direct marketing at any time. Rights are subject to lawful exceptions, including safety, fraud prevention, free-expression, recordkeeping, and legal claims.
Swift Tech, LLC is the controller for the processing described in this Policy unless a separate notice says otherwise. Contact us to ask about any representative or supervisory-authority details required for your location.
16. International transfers
Freely is operated from the United States. Information may be stored or processed in the United States and other countries where our providers operate, which may have different privacy laws. Where required, we use recognized safeguards such as adequacy decisions, standard contractual clauses, contractual protections, and security measures.
18. Adults only
Freely is not directed to anyone under 18, and minors may not use the Service. We do not knowingly collect personal information from minors. If you believe a minor has an account, report it through the App or contact us. We will investigate and delete or restrict information as appropriate, while retaining limited safety evidence where lawful and necessary.
19. Changes to this Policy
We may update this Policy to reflect legal, operational, security, or product changes. We will revise the date above and provide additional notice or obtain consent when required. Material changes apply prospectively from the stated effective date.
